Terms & Conditions

Opening Accounts
· Opening a new account is subject to credit approval. 
· If distribution account is pending setup, Lumivert will ship orders on COD terms at its discretion.
· For approved accounts, standard payment conditions are set at Net 30. Terms with additional discounts will be considered on an individual basis upon distributor request.

Conditions of Sales Orders
· Orders must be submitted in written form via fax or email.
· All orders must meet a minimum of $300 to avoid additional fees. Orders that do not meet the $300 minimum are subject to an additional fee of $25.
· If an item is out of stock, Lumivert’s customer service will notify the customer immediately to give the option of backorder or cancellation. All backorders will be shipped once inventory is received in our warehouse.
. Custom fabricated and special order items require a 50% deposit prior to order processing. 

Shipping Policy
. Orders that meet $800 or more qualify for free delivery within the local Houston area. Any orders less than $800 can be picked up at our warehouse location. The client will be notified via email or phone when the order is ready for pick-up. In the event that delivery is necessary for orders in the amount of less than $800, a delivery fee of $35 will be added to the customer’s invoice.
· SHIPPING INSIDE TEXAS: Orders that meet $1800 or more that are shipped within the state of Texas qualify for business-to-business freight allowance. Freight allowance does not include special accessories or location.
· SHIPPING OUTSIDE TEXAS**: Orders of $3000.00 or more qualify for freight allowance of a single business-to-business shipment. Customer will incur freight charges for split shipments beyond the first shipment. We reserve the right to choose the carrier for all shipments. Unless specified, all shipments are shipped standard freight/ground. All third-party shipments and any additional charges not associated with standard business-to-business shipping will be passed to customer (example: accessory fees, construction and residential fees, etc.). · Orders shipped to a third party are subject to an additional fee of $25.
· All orders refused by client or returned by the shipping company are subject to a 25% restocking fee.
** Shipping applies within the continental United States. Lumivert does not ship to Hawaii or Alaska.

Cancellations
· Special orders and orders for modified items cannot be cancelled.
· Cancellations for existing orders will be considered by Lumivert on an individual basis with costs already incurred as a deciding factor. Cancellations to unprocessed orders will be granted without charge.

Pricing
· Pricing is subject to change without notification.

Returns
· All shipments should be inspected before being accepted from the carrier. Notify the carrier immediately after inspecting shipments should damage or loss occur.
· Goods will not be returned without prior authorization. A request for return of goods must be submitted in writing to customer service. Once the request is approved, a Return of Goods Authorization number will be issued. Please re-ship or deliver the returned goods carefully packaged with the RGA number indicated on the outside. Unauthorized returns will be refused. No RGA authorization will be granted one year after purchase date. All stock items are subject to a restocking fee of 20%, with the exceptions of products deemed defective by Lumivert and incorrectly shipped orders. Non-stock and job-specific items that are approved for return are subject to a 50% restocking fee.

· Claims for damaged and broken items should be filed with both the carrier and Lumivert. The carrier is liable for all loss or breakage that occurs in transit. Claims for breach of articles must be submitted to Lumivert’s customer service within 10 days of receipt.

Warranty and Liability
· Lumivert guarantees the original purchaser that regularly stocked products are free of defect for one year from date of product ship date. In the event of defective product, our obligation to the customer is solely to replace or repair the item in question once an RGA has been authorized. The warranty does not apply to products that have been damaged through modification, misuse, abuse, improper installation, mishandling, or accident. Within the one-year warranty, written notification of defective product must be submitted. For material damaged in shipping, Lumivert must be notified of damaged within 10 days of consignee’s receipt noted in the Returns section above.
· For outdoor products, it is our obligation to ensure the product is mechanically functional. Lumivert disclaims any responsibility for damage to the housing and finish due to natural causes such as, but not limited to, inclement weather. It is the end-user’s obligation to ensure that the fixture is installed properly to avoid such damage.
·LED mirrors and custom fabricated products are subject to individual product warranties set by Lumivert. Warranty does not apply to lamps. If a non-Lumivert branded lamp is supplied within fixture packaging, the original manufacturer’s warranty will apply.
